TERMS OF SERVICE

1. About OnCall Pain

ONCALL PAIN, LLC (“OnCall Pain,” “we,” or “us”) is a healthcare management organization that provides administrative, operational, and compliance support to independently contracted healthcare providers practicing at affiliated clinic locations.
 

OnCall Pain does not practice medicine, diagnose conditions, or prescribe medications.

These Terms of Service (“Terms”), together with our Privacy Policy and other incorporated policies (collectively, the “Agreement”), govern your use of our website, scheduling tools, and related services (the “Services”).

By accessing or using the Services, you agree to be bound by this Agreement.

2. Medical Services and Providers

Medical services are provided exclusively by appropriately licensed, board-certified healthcare practitioners who are independently contracted to provide services through OnCall Pain (“Providers”).

Providers are not employees or agents of OnCall Pain and exercise independent professional judgment in all clinical matters.

Medical services are primarily provided through in-person, face-to-face visits at an OnCall Pain clinic location. In limited circumstances, telemedicine or virtual visits may be offered at the discretion of the Provider, when clinically appropriate and permitted by applicable law.

Any prescribing of controlled substances facilitated through telemedicine technologies by licensed Providers is conducted in compliance with applicable federal and state laws and regulations in effect at the time of prescribing.

Controlled substance prescriptions are issued only when permitted by law, based on the Provider’s independent clinical judgment, and when appropriate patient evaluations and documentation requirements have been satisfied.

3. Prescribing Authority

OnCall Pain does not prescribe medications.

All prescribing decisions are made independently by licensed Providers in accordance with applicable federal and state laws, professional standards, and the Provider’s clinical judgment.

OnCall Pain does not direct, control, or influence prescribing decisions.

4. No Provider–Patient Relationship with OnCall Pain

Use of the Site or Services does not create a provider–patient relationship between you and OnCall Pain.

Any provider–patient relationship exists solely between you and the independently contracted Provider who delivers your care. OnCall Pain is not responsible for medical decision-making, treatment outcomes, or clinical services rendered.

5. Informational Content Disclaimer

Any content made available through the Site or Services is provided for general informational, administrative, or scheduling purposes only and is not medical advice.

Nothing on the Site is intended to substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider regarding medical conditions or treatment decisions.

Do not use the Services for emergency medical needs. In the event of an emergency, call 911 immediately.

6. No Guarantee of Treatment or Medication

Acceptance as a patient, continuation of care, or receipt of any particular treatment or medication is not guaranteed. Treatment decisions may change based on clinical findings, compliance with clinic policies, safety considerations, or Provider discretion.

7. Patient Responsibilities

You agree to:

  • Provide accurate and complete information

  • Attend scheduled in-office appointments

  • Comply with clinic policies and treatment plans

  • Use the Site and Services only for lawful purposes

You are responsible for all charges associated with medical services rendered by Providers.

8. No Endorsement of Providers

OnCall Pain does not recommend or endorse any specific Provider, treatment, test, or medical opinion. You are solely responsible for selecting your healthcare Provider.

9. Changes to Services

We may modify, suspend, or discontinue any portion of the Services at any time. OnCall Pain is not liable for any modification or discontinuation of the Services.

10. Intellectual Property

All content on the Site is owned by OnCall Pain or its licensors and is protected by applicable intellectual property laws. Content may be used for personal, non-commercial purposes only.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONCALL PAIN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

To the maximum extent permitted by law, OnCall Pain shall not be liable for any indirect, incidental, consequential, or special damages, including damages arising from medical services provided by independent Providers.

OnCall Pain’s total liability for any claim shall not exceed the greater of (a) fees paid by you to OnCall Pain in the prior six (6) months, or (b) $100.

13. Indemnification

You agree to indemnify and hold harmless OnCall Pain and its affiliates from any claims arising out of your use of the Services or violation of this Agreement.

14. Termination

We may suspend or terminate your access to the Services at any time for violation of this Agreement or applicable policies.

15. Governing Law and Arbitration

This Agreement is governed by the laws of the State of Arizona. Any disputes shall be resolved through binding individual arbitration, and you waive any right to participate in class actions or jury trials.

16. Miscellaneous

This Agreement constitutes the entire agreement between you and OnCall Pain. If any provision is held unenforceable, the remaining provisions shall remain in effect.

We may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.
