NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1. Who This Notice Applies To
This Notice of Privacy Practices (“Notice”) describes the privacy practices applicable to protected health information (“PHI”) created, received, or maintained in connection with care provided at OnCall Pain’s affiliated clinic locations and by the healthcare practitioners who provide services through OnCall Pain.
OnCall Pain provides administrative, operational, and compliance support to independently contracted healthcare practitioners providing services at affiliated clinic locations. OnCall Pain does not itself practice medicine or prescribe medications.
Medical services are primarily provided through in-person visits by board-certified, independently contracted providers (“Providers”). In limited circumstances, telemedicine services may be offered at the discretion of the Provider, when clinically appropriate and permitted by law. All clinical decisions, including prescribing decisions, are made independently by Providers in accordance with applicable law and professional standards.
This Notice applies to PHI created, received, or maintained in connection with your care and related administrative services, as described below.

We understand that information about you and your health is personal. We are committed to protecting your PHI.

3. How We May Use and Disclose Your PHI (Without Your Written Authorization)
The categories below describe the most common ways PHI may be used and disclosed. Not every use or disclosure in a category is listed.
A. For Treatment
We may use your PHI to provide, coordinate, or manage your care. We may disclose PHI to Providers, nurses, technicians, students, or other personnel involved in your care, as well as to other healthcare providers (such as laboratories, pharmacies, or specialists) as necessary for treatment.
B. For Payment
We may use and disclose PHI to bill and collect payment for services, including billing you, your health plan, or a third party. This may include eligibility checks, claims submissions, prior authorization, and payment processing.
C. For Health Care Operations
We may use and disclose PHI for health care operations, including quality improvement, compliance activities, licensing, credentialing, audits, training, and business management. De-identified information may be used for operational and analytic purposes.
D. Appointment Reminders and Care Communications
We may contact you to remind you of appointments, follow-ups, or other care-related information. Communications may occur by phone, email, or text message unless you request an alternative method.
E. Treatment Alternatives and Health-Related Benefits or Services
We may use PHI to inform you about treatment options, alternatives, or health-related services that may be relevant to your care.
F. As Required by Law
We may disclose PHI when required to do so by federal, state, or local law.
G. Public Health and Safety Activities
We may disclose PHI for public health activities such as reporting disease, adverse reactions to medications, product recalls, or suspected abuse, neglect, or domestic violence when required or authorized by law.
H. Health Oversight Activities
We may disclose PHI to health oversight agencies for audits, investigations, inspections, licensure, or other activities authorized by law.
I. Legal Proceedings
We may disclose PHI in response to a court or administrative order, subpoena, discovery request, or other lawful process, consistent with applicable law.
J. Law Enforcement
We may disclose PHI to law enforcement officials as required or permitted by law, including to report certain injuries, locate a suspect or missing person, or address suspected criminal activity.
K. Coroners, Medical Examiners, and Funeral Directors
We may disclose PHI as necessary to assist coroners, medical examiners, or funeral directors in carrying out their duties.
L. Organ and Tissue Donation
If you are an organ donor, we may disclose PHI to organizations involved in organ procurement or transplantation as necessary.
M. Military, Veterans, National Security, and Protective Services
We may disclose PHI as required for military command authorities, veterans’ affairs, national security, intelligence activities, or protective services authorized by law.
N. Workers’ Compensation
We may disclose PHI for workers’ compensation claims or similar programs that provide benefits for work-related injuries or illnesses.
O. Inmates and Correctional Institutions
If you are an inmate or otherwise in custody, we may disclose PHI to correctional institutions or law enforcement as permitted by law.
P. Disaster Relief
We may disclose limited PHI to assist disaster relief efforts so that family members may be notified of your condition, status, and location.
4. Uses and Disclosures That Require Your Written Authorization
We will obtain your written authorization before using or disclosing PHI for purposes not described in this Notice, unless otherwise permitted or required by law.
Written authorization is generally required for:

Marketing uses or disclosures (as defined by HIPAA), unless an exception applies

Sale of PHI

Certain disclosures of psychotherapy notes, if applicable
You may revoke an authorization in writing at any time, except to the extent action has already been taken based on the authorization.
5. Research
PHI may be used or disclosed for research purposes only as permitted by law. When required, written authorization will be obtained, or PHI may be disclosed under an Institutional Review Board or Privacy Board waiver or other lawful process that protects your privacy.
6. Your Rights Regarding Your PHI
You have the following rights regarding PHI maintained about you:
A. Right to Inspect and Obtain a Copy
You may request access to or a copy of PHI used to make decisions about your care. Requests must be submitted in writing.
B. Right to Request an Amendment
You may request an amendment to PHI you believe is incorrect or incomplete. Requests must be submitted in writing and must state the reason for the amendment. Requests may be denied under certain circumstances.
C. Right to an Accounting of Disclosures
You may request a list of certain disclosures of PHI made by us, as allowed by law.
D. Right to Request Restrictions
You may request restrictions on certain uses or disclosures of PHI. We are not required to agree to all requested restrictions.
If you pay for a service in full out-of-pocket and request that PHI related to that service not be disclosed to your health plan for payment or operations, we will comply unless disclosure is required by law.
E. Right to Request Confidential Communications
You may request communications in a specific manner or at a specific location. Reasonable requests will be accommodated.
F. Right to a Paper Copy of This Notice
You may request a paper copy of this Notice at any time.

8. Complaints
If you believe your privacy rights have been violated, you may file a complaint with OnCall Pain using the contact information above.
You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
9. Changes to This Notice
We reserve the right to change this Notice at any time. Any revised Notice will apply to PHI already maintained as well as PHI received in the future.
Material changes will be posted on our website and made available at clinic locations. Each version will include an effective date.
